“Ring, ring. Ring, ring,” sounded the phone yesterday morning. I answered it.
“Hello, this is Annabel from the Estate Agent’s office. We will be holding an open house at your unit on Saturday between 11 and 12 o’clock.”
“Oh, bloody hell,” I thought. The estate agent insists that we leave the premises when he holds an open house; apparently, he can’t sell a property with people sitting in it. And yet we have gone away for the past two Saturdays, and still he hasn’t sold the flat, which I take to be a reflection on the rather high asking price, but of course, I’m not an estate agent.
“Fine,” I said. “But we’re not going to be out this Saturday. It’s the hottest time of the day, and we’ve got a small child. We rent the flat for all the hours of the week so we expect to be allowed to sit in it all the hours of the week.” I was not in a good mood yesterday.
“Just a moment,” said Annabel. She put me on hold while she went to get the chief estate agent.
“We're going to hold an open house on Saturday,” he said.
“Fine,” I said. “But we will be there.”
“I’m going to ring the landlord, and he’s going to terminate your contract,” said the estate agent.
“I feel that you are bullying me,” I said.
“I’m not bullying you,” said the estate agent.
“Well, I feel bullied,” I said, and there the conversation ended.
When I got off the phone, I re-read the rental contract. It states that we have to let people in to view the flat, which we have been doing, but it says nothing about us having to go out so that the estate agent can hold an open house, in which he sticks a notice board in the street, inviting all passers by, which of course includes passing petty criminals, to come in and take a look at the property, with a view to buying it, or perhaps returning later and burgling it.

Call the Dept of Fair Trading, they will be able to tell you the deal here.
I know personally i have always insisted on being in my rental properties when they are being shown.

Just tell him if it's an open house and it's open to all it's open to you too :p
He has cancelled the open house, just the threat of us being there was too much of a risk for him. I now wonder what he does at these things that he does not want us, the tenants, there.

that guy is an a**hole! The very fact that he threatened you is enough to get him in some serious trouble.
Damn those real estate agents! They swindled me out of alot of money when I was trying to sell my apartment in Brisbane while I was living here in the States.
That is awful. When the house we were renting in Melbourne was being sold and we were having people look around about twice a week, we were given a discount on our rent.
At least in Australia your bond is not held by the real estate company or a scummy landlord.
That's a bit crap. Good on you for standing your ground!
That's absurd. Legally you have to let them have an open house - but they have to give you seven days notice, in writing, not just phone you on a thursday. I once turned an agent away, along with all the prospective viewers on the doorstep, because I hadn't been given notice about it.
Secondly, all your stuff in the in house - they are liable if anything is stolen.
And finally, if the owner wants to terminate the lease he has to pay you compensation.
This story just reminded me again of how much I hate Sydney real estate agents.
Real estate agents are all .. horrible people. This is my first comment on your blog so I don't want to start it off with a profanity! :D
I've had my fair share of run-ins with them in my last rental house. You don't have to be out of the property for an open house. I refused to let them in unless they had given the appropriate notice - in WRITING - and if I was there. If I couldn't be there, I would organise someone to come and be there for me.
Contact your rental tenants authority in your state. They will help you. Also the rental union - they can give you advice. If they terminate the contract, you have MAJOR grounds on which to appeal or ask for compensation.
Go you, for sticking up for the renters. Stupid real estate people.
Oh and also - invader stu has a good point. You can always "leave" the property and come back 2 minutes later as "prospective buyers"... ;)

Everyone else has explained why.
From this behaviour, I think I even know who the agent is - sounds like the agent that Mrs Albion used to rent from. She wanted to terminate early to move in with me. They said she'd have to pay compensation to cover the period until they found another tenant - which they said would be a long time, because the market was flat.
Having seen the crappiness of their business on every level, we placed our own ad, held our own open house and handed them three rental application forms on the monday. We even managed to sell some furniture to the new tenant.
Your agent is an idiot.
I am going to write a letter of complaint to the Institute of Real Estate Agents. I suspect that I am not the first person that he has bullied.
